Terms of Service

1. Parties and acceptance
These terms govern services provided by Android App Hero, operated by Andrés Garrido from Chile (“Android App Hero,” “provider,” “I,” or “me”), to the business or professional identified in an accepted written scope (“client” or “you”). A paid engagement begins only when the written scope is accepted, payment is received, required access is available, and any agreed contracting or NDA steps are complete.
2. The Android Rescue Sprint
The standard US$499 sprint covers one approved, bounded Android issue. The written scope will define the problem, acceptance criteria, deliverables, required access, known exclusions, dependencies, and start conditions. Website descriptions are general and do not override the accepted written scope.
The standard deliverable is one review-ready pull request or, when access is restricted, a patch or diff, accompanied by a diagnosis summary and reasonable validation notes. Unit tests are included when practical and proportionate to the repository and issue.
3. Timeline
The five-business-day implementation period begins only after all start conditions in the written scope are satisfied: acceptance, payment, functioning access, and clarified questions. The timeline pauses for client delays, unavailable environments, missing credentials, third-party outages, changed requirements, or dependencies outside the approved Android scope.
4. Client responsibilities
You agree to provide accurate information, lawful authorization to access the relevant code and systems, a technically usable development environment, timely answers, and a qualified reviewer. You must back up systems and review, test, approve, merge, release, and monitor any change under your own engineering and release procedures.
5. Review and included revision
One consolidated change request is included when it relates directly to the accepted criteria and is submitted within the review period stated in the written scope. The included revision is normally delivered within one business day after a clear request is received. New requirements, expanded edge cases, unrelated cleanup, preference changes, repository changes made after delivery, or requests outside the accepted criteria are additional scope.
6. Larger or unsuitable work
ANR investigations without a strong diagnostic signal, major migrations, architecture programs, large features, broad refactoring, backend work, and complex device-fleet edge cases are not part of the standard sprint unless explicitly stated. A separate proposal may be offered, but you are not required to accept it and no additional work begins without written approval.
7. Fees, taxes, and payment
The standard sprint fee is US$499 unless the accepted written scope states otherwise. Payment is due before the implementation period begins. The client is responsible for bank, platform, currency-conversion, withholding, and similar charges imposed on its side, and for any taxes it is legally required to pay or withhold. Payment methods may include Wise, PayPal, Payoneer, or another agreed method.
8. Refunds
Refund eligibility is governed by the Refund Policy and any more specific term in the accepted written scope. The primary technical guarantee applies when hidden constraints make the approved Android fix infeasible within the sprint despite accurate information and timely access.
9. Intellectual property
After full payment, the client receives ownership of original project-specific code created specifically for the accepted deliverable, to the extent transferable under applicable law. Pre-existing tools, generalized knowledge, templates, utilities, methods, and know-how remain the provider’s property. Open-source software and third-party materials remain subject to their existing licenses.
10. Confidentiality and access
Confidential information will be used only to evaluate or perform the engagement and will be protected with reasonable care. A separate NDA may be signed before sensitive access. You must provide the minimum access reasonably required and revoke it after the engagement. Credentials must not be submitted through the public website form.
11. No guarantee of external outcomes
The service does not guarantee that a pull request will be merged, released, approved by an app store, accepted by every reviewer, eliminate every related edge case, improve ratings, increase revenue, prevent future defects, or work with systems and versions not included in the acceptance criteria. Software changes can have unforeseen effects; the client remains responsible for independent review, testing, backup, release, and monitoring.
12. Warranties and liability
Services are performed with reasonable professional care. Except for express commitments in the accepted scope and to the maximum extent allowed by law, the service is provided without other warranties. Neither party is liable for indirect, incidental, special, punitive, or consequential loss, lost profit, lost revenue, lost data, or business interruption. The provider’s total liability related to a sprint will not exceed the fees paid for that sprint, except where such limitation is prohibited by law.
13. Termination
Either party may terminate before the sprint starts. After the sprint begins, termination and refund rights follow the accepted scope and Refund Policy. The provider may suspend or terminate work for unlawful requests, abuse, security risk, non-payment, unauthorized access, or material breach.
14. Governing law and disputes
Unless a signed agreement states otherwise, these terms are governed by the laws of Chile, without regard to conflict-of-law rules. The parties will first attempt in good faith to resolve disputes through written discussion. Courts with jurisdiction in Santiago, Chile will have jurisdiction, subject to any mandatory law that cannot be excluded.
